Welcome to Northwarm. "We", "us" and "our" refer to Northwarm, located at Calle de los Estudios 3, 22400 Monzón (Huesca), Spain, which operates this store and all of its content, features and services (the "Services").
These Terms of Service, together with the policies linked from them, describe your rights and ours when you use the Services. Please read them carefully: they include information about returns, warranties and liability. By using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
If you're a consumer, your statutory rights come first. Nothing in these Terms limits, excludes or replaces the rights you have under the consumer protection laws of your country, including any legal right to cancel and your rights for faulty goods.
1. Access and account
To buy from us you must be of legal age in your country of residence. If you let a minor in your care use your devices, you're responsible for that use.
We may ask for contact, billing, payment and shipping details. You agree that they're accurate and up to date, and you're responsible for keeping your account credentials safe. You can't transfer your account to anyone else.
2. Our products
We do our best to show our products accurately, but colors and appearance can vary depending on your screen.
Northwarm vests are low-voltage (5V USB) heated garments. Please follow the instructions that come with your vest: start on the lowest setting, don't sleep with the heat switched on, don't use the heat function on anyone who can't feel heat properly or can't take the vest off by themselves (such as young children), and stop using it if you feel any discomfort. If you're pregnant or have a medical condition that affects your circulation or sensitivity to heat, check with your doctor before using heated clothing. Only use a working power bank with an output of 5V/2A or higher.
We may update product descriptions, stop selling a product or limit quantities at any time. These changes never affect an order we've already accepted.
3. Orders
When you place an order, you're making an offer to buy. The contract is formed when we confirm by email that we've accepted your order. We may refuse an order for a good reason, such as lack of stock, an obvious pricing error or suspected fraud; if we do, we'll refund anything you've paid in full.
If you need to cancel or change your order, email us as soon as possible: if it hasn't shipped yet, we'll take care of it. Our products are sold for personal use, not for resale.
4. Prices and payment
Prices and promotions may change without notice, but the price you pay is always the one shown when you placed your order, as stated in your order confirmation. Prices are shown in your local currency (US dollars, British pounds or Canadian dollars) and shipping is free.
Depending on your country, customs may charge import duties or taxes that aren't included in our prices and are paid by the recipient, as explained in our Shipping policy. By paying, you confirm that you're authorized to use the payment method you provide and that your details are correct.
5. Shipping and delivery
Delivery times are estimates. How we ship, how long it takes and what happens if a package is lost, stolen or damaged are explained in our Shipping policy. We aren't responsible for delays caused by customs procedures or events beyond our reasonable control, but this doesn't affect any right you have to cancel if your order doesn't arrive.
6. Returns and refunds
You can ask for a refund within 90 days of the date your order ships, as described in our Refund policy. This guarantee is in addition to your statutory rights for faulty goods, which these Terms don't limit in any way.
7. Intellectual property
The content of the Services, including our brand, logo, text, images, graphics, videos and design, belongs to us or our licensors and is protected by intellectual property laws. You may use the Services for your own personal, non-commercial use. You may not reproduce, distribute, modify, republish or exploit our content without our prior written permission.
Shopify's name, logo and designs are trademarks of Shopify. Other trademarks that appear on the Services belong to their respective owners.
8. Third-party tools and links
The Services may give you access to third-party tools or links that we don't control. They're provided "as is" and you use them at your own risk, subject to the third party's own terms. Questions or complaints about third-party products or services should be directed to that third party.
9. Relationship with Shopify
Northwarm is powered by Shopify, which enables us to provide the Services to you. However, any purchase you make on our store is made directly with Northwarm. By using the Services, you acknowledge and agree that Shopify isn't responsible for any aspect of the sales between you and Northwarm, including any injury, damage or loss resulting from purchased products and services, and you expressly release Shopify and its affiliates from all claims related to your purchase.
10. Privacy
We process your personal information as described in our Privacy Policy. Because our store is hosted by Shopify, Shopify also collects and processes information about your access to and use of the Services, and may transfer it to third parties in other countries in order to provide the Services.
11. Reviews and other content you send us
If you send us reviews, photos, ideas or other content, you give us permission to use, reproduce and display it in any media, including for commercial purposes, without any obligation to compensate you.
When you send content, you confirm that it's yours or that you have the right to share it, that it's truthful, that you've told us about any compensation or incentive you received for posting it, and that it doesn't infringe anyone's rights or contain unlawful, offensive or misleading material. We may, but don't have to, review, edit or remove content we consider inappropriate.
12. Errors
There may occasionally be typos, inaccuracies or omissions in product descriptions, prices, promotions or delivery times. We may correct them and update information at any time. If an error affects an order you've already placed, we'll contact you before doing anything, and you can either confirm the order at the correct price or cancel it for a full refund.
13. Prohibited uses
You may only use the Services for lawful purposes. In particular, you may not use them to break the law or infringe anyone's rights; to harass, defame or harm anyone; to send false or misleading information or unsolicited advertising; to impersonate another person; or to introduce viruses or malicious code. You also may not scrape, copy, resell or exploit any part of the Services, collect other users' personal information, or get around our security measures. We may suspend access for anyone who breaks these rules.
14. Automated agents
If you use, or allow, software that acts autonomously or semi-autonomously on someone's behalf (an "Agent") to access the Services, the Agent must identify itself as such, must not disguise itself as a human or solve or bypass CAPTCHAs, must answer truthfully if asked whether it's human, and must not get around measures that limit its access. We may technically restrict any Agent's access.
15. Liability
We're responsible for loss or damage we cause by breaking these Terms or by failing to use reasonable care and skill, in accordance with the applicable law.
We never exclude or limit our liability for death or personal injury caused by our negligence, for fraud or gross negligence, for defective products under product liability law, or for anything else that the law doesn't allow us to exclude or limit.
Apart from those cases, and to the extent the law allows, we aren't responsible for indirect losses, loss of profits, or losses that weren't foreseeable when you placed your order.
16. Severability
If any part of these Terms is found to be invalid or unenforceable, it will be treated as removed and the rest of the Terms will remain fully in force.
17. Entire agreement and assignment
These Terms and the policies linked from them are the entire agreement between you and us about your use of the Services. If we don't enforce a right at a particular moment, that doesn't mean we've given it up.
You may not transfer your rights or obligations without our written consent. We may transfer ours, as long as this doesn't reduce your rights as a consumer; if we do, we'll let you know.
18. Governing law and disputes
These Terms are governed by Spanish law. If you're a consumer, this doesn't take away any protection you have under the mandatory consumer laws of the country where you live, and you can bring a claim in the courts where you live.
Before it gets to that point, please email us: we resolve almost everything by email.
19. Changes to these Terms
We may update these Terms from time to time. The current version is always the one published on this page, with its date at the top. Changes don't apply retroactively to orders already placed, and if a change is significant, we'll let you know.
